UT Tech Solutions (जिसे आगे “Uttarottar”, “कंपनी” या “हम” कहा गया है) द्वारा प्रदान की गई Android App “UT Tech Solutions”, APIs और अन्य डिजिटल सेवाओं (सामूहिक रूप से “सेवाएँ”) का उपयोग करने से पहले कृपया इन नियमों और शर्तों को ध्यानपूर्वक पढ़ें।

सेवाओं का उपयोग करके आप इन नियमों, हमारी Privacy Policy, Refund Policy और Disclaimer से सहमत होते हैं।

1. सेवाओं की प्रकृति

1.1 कंपनी तृतीय-पक्ष API सेवा प्रदाताओं से प्राप्त सेवाओं को एक यूज़र-फ्रेंडली इंटरफ़ेस के माध्यम से उपलब्ध कराती है।

1.2 कंपनी स्वयं किसी भी सरकारी डेटाबेस की स्वामी नहीं है और केवल तकनीकी सुविधा प्रदान करती है।

1.3 सभी सेवाएँ सशुल्क (Prepaid Paid Services) हैं और भुगतान के बाद ही उपलब्ध कराई जाती हैं।

2. पात्रता और खाता

2.1 उपयोगकर्ता की आयु कम से कम 18 वर्ष होना आवश्यक है।

2.2 उपयोगकर्ता द्वारा दी गई जानकारी सही, पूर्ण और अद्यतन होनी चाहिए।

2.3 खाते की सुरक्षा, OTP, API Key, पासवर्ड आदि की गोपनीयता बनाए रखना उपयोगकर्ता की जिम्मेदारी है।

2.4 किसी भी अनधिकृत उपयोग की स्थिति में उपयोगकर्ता तुरंत कंपनी को सूचित करेगा।

3. API और डेटा उपयोग

3.1 API सेवाएँ केवल वैध और व्यक्तिगत उपयोग के लिए हैं।

3.2 बिना वैध अनुमति किसी अन्य व्यक्ति की जानकारी निकालना, KYC डेटा का दुरुपयोग, डेटा स्क्रैपिंग, पुनर्विक्रय या अवैध प्रोसेसिंग प्रतिबंधित है और भारतीय कानूनों के अंतर्गत दंडनीय हो सकता है। इसकी पूर्ण जिम्मेदारी उपयोगकर्ता की होगी ।

3.3 उपयोगकर्ता यह सुनिश्चित करेगा कि वह किसी भी व्यक्तिगत डेटा को प्रोसेस करते समय DPDP Act, 2023 तथा IT Act, 2000 का पालन कर रहा है।

3.4 किसी भी दुरुपयोग, अवैध प्रोसेसिंग या थर्ड-पार्टी डेटा उल्लंघन के लिए कंपनी जिम्मेदार नहीं होगी। इसकी पूर्ण जिम्मेदारी उपयोगकर्ता की होगी।

4. निषिद्ध गतिविधियाँ

• अवैध, धोखाधड़ी या भ्रामक उद्देश्य से सेवाओं का उपयोग
• API Keys को साझा करना या व्यावसायिक पुनर्विक्रय
• सिस्टम, सर्वर, नेटवर्क पर हमला, ओवरलोड या बाधा उत्पन्न करना
• मैलवेयर, वायरस, बॉट या ऑटोमेशन के माध्यम से दुरुपयोग
• किसी भी प्रकार का डेटा माइनिंग या अनधिकृत स्टोरेज

5. Android App – UT Tech Solutions

5.1 यह ऐप लाइसेंस के रूप में प्रदान किया जाता है, बिक्री के रूप में नहीं।

5.2 ऐप के परिणाम केवल सूचना के उद्देश्य से हैं। किसी भी कानूनी, वित्तीय या व्यावसायिक निर्णय से पहले उपयोगकर्ता स्वयं सत्यापन करेगा।

5.3 कंपनी किसी भी समय फीचर, मूल्य, API स्रोत या सेवा को संशोधित, निलंबित या बंद करने का अधिकार सुरक्षित रखती है।

6. भुगतान, वैधता और रिफंड

6.1 सभी भुगतान अग्रिम (Prepaid) होंगे और उपयोग के आधार पर समायोजित किए जाएंगे।

6.2 API बैलेंस, क्रेडिट या सब्सक्रिप्शन गैर-हस्तांतरणीय हैं।

6.3 रिफंड केवल हमारी आधिकारिक Refund Policy के अनुसार ही दिया जाएगा:

6.4 सेवा उपयोग होने के बाद सामान्यतः कोई रिफंड देय नहीं होगा।

7. डेटा गोपनीयता और लॉगिंग

7.1 कंपनी खाता प्रबंधन, सुरक्षा और ऑडिट के लिए मोबाइल नंबर, भुगतान विवरण, उपयोग लॉग, IP एड्रेस और ट्रांजैक्शन इतिहास संग्रहित कर सकती है।

7.2 डेटा सुरक्षित सर्वर पर संग्रहीत किया जाता है और केवल वैध उद्देश्य के लिए उपयोग किया जाता है।

7.3 उपयोगकर्ता अनुरोध पर डेटा हटाया जा सकता है, जब तक कि कानूनन आवश्यक न हो।

8. अस्वीकरण (Disclaimer)

8.1 सभी डेटा तृतीय-पक्ष स्रोतों से प्राप्त होता है, जिसकी पूर्ण शुद्धता की गारंटी नहीं दी जा सकती।

8.2 सेवाएँ “As-Is” और “As-Available” आधार पर प्रदान की जाती हैं।

9. दायित्व की सीमा (Limitation of Liability)

कंपनी निम्न के लिए उत्तरदायी नहीं होगी:

• डेटा त्रुटि, विलंब या अनुपलब्धता
• व्यापारिक नुकसान, लाभ हानि या अप्रत्यक्ष नुकसान
• उपयोगकर्ता द्वारा कानून का उल्लंघन
• तृतीय-पक्ष API सेवा बाधा

10. क्षतिपूर्ति (Indemnity)

उपयोगकर्ता कंपनी को किसी भी दावे, नुकसान, दंड, कानूनी कार्यवाही या खर्च से सुरक्षित रखेगा जो उसके द्वारा किए गए अवैध उपयोग, डेटा दुरुपयोग या नियमों के उल्लंघन से उत्पन्न हो।

11. सेवा निलंबन और समाप्ति

11.1 नियमों के उल्लंघन, संदिग्ध गतिविधि, भुगतान विफलता या कानूनी निर्देश पर कंपनी सेवा निलंबित या समाप्त कर सकती है।

11.2 उपयोगकर्ता किसी भी समय सेवाओं का उपयोग बंद कर सकता है, परंतु भुगतान वापसी नीति के अधीन होगा।

12. लागू कानून और क्षेत्राधिकार

ये नियम भारत के कानूनों, IT Act 2000 तथा DPDP Act 2023 के अधीन होंगे।

सभी विवादों का निपटारा Nohar – 335523, राजस्थान के न्यायालय में किया जाएगा।

13. संशोधन

कंपनी समय-समय पर इन नियमों में संशोधन कर सकती है। सेवाओं का निरंतर उपयोग संशोधित नियमों की स्वीकृति माना जाएगा।

Please read these Terms & Conditions carefully before using the Android App “UT Tech Solutions”, APIs, and other digital services provided by UT Tech Solutions (hereinafter referred to as “Uttarottar”, “Company”, “We”, or “Us”). By accessing or using our services, you agree to be legally bound by these Terms, our Privacy Policy, Refund Policy, and Disclaimer.

1. Nature of Services

1.1 UT Tech Solutions is a technology service provider that facilitates access to data and services obtained from third-party API providers through a user-friendly interface.

1.2 The Company does not own any government database and acts only as an intermediary technology platform.

1.3 All services are strictly prepaid paid services unless explicitly stated otherwise.

2. Eligibility and Account

2.1 Users must be at least 18 years of age and legally capable of entering into a binding agreement.

2.2 Users must provide accurate and up-to-date information and are solely responsible for maintaining the confidentiality of their login credentials, API keys, and OTPs.

2.3 Any unauthorized use of the account must be reported to the Company immediately.

3. API and Data Usage

3.1 API services are provided only for lawful and personal or authorized business use.

3.2 Extraction, storage, resale, scraping, or processing of personal data of any third party without lawful basis or consent is strictly prohibited and may attract liability under the IT Act, 2000 and DPDP Act, 2023.

3.3 Users shall ensure compliance with all applicable data protection and privacy laws while using the services.

3.4 The Company shall not be responsible for any misuse of data or unlawful processing carried out by the user.

4. Prohibited Activities

• Using services for illegal, fraudulent, misleading, or unauthorized purposes
• Sharing or reselling API keys, credits, or access
• Attempting to damage, hack, overload, or disrupt servers or networks
• Using bots, automation, malware, or harmful code
• Unauthorized data mining, bulk extraction, or storage

5. Android App – UT Tech Solutions

5.1 The app is licensed and not sold to the user.

5.2 All outputs are for informational purposes only and must be independently verified before making legal, financial, or business decisions.

5.3 The Company reserves the right to modify features, pricing, API sources, suspend, or discontinue services at any time without prior notice.

6. Payment, Validity and Refund

6.1 All services are prepaid and usage-based.

6.2 API credits, wallet balance, and subscriptions are non-transferable and non-refundable except as per our Refund Policy:

6.3 No refund shall be issued once the service has been consumed unless required by law.

7. Privacy, Logging and Data Retention

7.1 The Company may store user information including mobile number, transaction details, IP address, device details, and usage logs for security, audit, billing, and legal compliance purposes.

7.2 Data is stored securely and used only for legitimate business and compliance purposes.

7.3 Users may request deletion of their personal data subject to legal retention requirements.

8. Disclaimer

8.1 All data is sourced from third-party providers and the Company does not guarantee absolute accuracy, completeness, or timeliness.

8.2 Services are provided on an “As Is” and “As Available” basis.

9. Limitation of Liability

The Company shall not be liable for any direct, indirect, incidental, consequential, or business losses including but not limited to:

• Incorrect or delayed data
• Service downtime or third-party API failure
• User’s unlawful use of services
• Loss of business, revenue, or profit

10. Indemnity

The user agrees to indemnify and hold harmless the Company from any claims, penalties, damages, legal actions, or costs arising out of misuse of services, unlawful data processing, or violation of these Terms.

11. Suspension and Termination

11.1 The Company may suspend or terminate access without notice in case of policy violation, suspicious activity, payment failure, or legal requirement.

11.2 Users may discontinue use at any time, subject to the refund policy.

12. Governing Law and Jurisdiction

These Terms shall be governed by the laws of India, including the IT Act, 2000 and DPDP Act, 2023.

All disputes shall be subject to the exclusive jurisdiction of courts at Nohar – 335523, Rajasthan.

13. Amendments

The Company reserves the right to modify these Terms at any time. Continued use of the services constitutes acceptance of the updated Terms.
